Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and Why Not Initiatives (“MyInteractiveCV,” “we,” “us,” or “our”), the operator of the service available at myinteractive.cv (the “Service”). Please read them carefully. By creating an account or using the Service in any way, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Service.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of the Service

MyInteractiveCV is a SaaS platform that lets candidates upload a resume, parse and structure it with AI, customize an AI-powered chatbot (a “Bot”), and publish that Bot at a unique URL (for example, myinteractive.cv/bot/your-slug) so that recruiters and other visitors can converse with it. The Service also includes optional analytics, AI-generated insights from completed conversations, and notification emails.

We may add, modify, or discontinue features at any time. Where a change materially reduces your rights, we will provide reasonable advance notice via email or in-product notice.

3. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you are 16 or older. We do not knowingly collect personal data from anyone under 16. If we learn that we have collected data from a user under 16, we will delete it.

You must also have legal capacity to enter into a binding contract in your jurisdiction and must not be barred from using the Service under any applicable law.

4. Accounts and Security

To use most features, you create an account by providing an email address and password (passwords are stored only as salted hashes by our authentication provider). You agree to:

  • Provide accurate, current information and keep it updated.
  • Maintain the confidentiality of your credentials and not share them.
  • Be responsible for all activity that occurs under your account.
  • Notify us promptly at support@myinteractive.cv of any unauthorized access.

When you sign up, we create your account and Bot record optimistically before email confirmation so that the upload experience is seamless. If you do not confirm your email within 24 hours, an automated daily process deletes the unverified record. See our Privacy Policy for details.

5. Acceptable Use

You agree not to use the Service to:

  • Upload content that is false, misleading, defamatory, obscene, discriminatory, harassing, or otherwise unlawful.
  • Upload resumes or personal information that is not yours, or impersonate any person.
  • Infringe any intellectual property, privacy, publicity, or other right of a third party.
  • Attempt to probe, scan, reverse-engineer, decompile, or disrupt the Service or its infrastructure.
  • Use automated means (scrapers, bots) to access the Service in excess of normal human use, or interfere with our rate limits, CAPTCHA, or other protective measures.
  • Send unsolicited communications using URLs, email addresses, or contact details obtained through the Service.
  • Use the Service to train competing AI models or to compile datasets of personal information.
  • Violate any applicable law, regulation, or third-party agreement.

We may suspend or terminate accounts that violate these rules, with or without notice, in our reasonable discretion.

6. Your Content and License to Us

You retain all ownership of the content you upload to the Service — your resume, profile data, Bot settings, custom instructions, and any other material you submit (collectively, “Your Content”).

You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, display, process, and create derivative works of Your Content solely to operate and improve the Service — for example, to parse your resume with AI, to generate Bot responses, to deliver conversations to recruiters you choose to share with, and to generate the insights and analytics we display to you. This license ends when you delete Your Content or your account, except as described in our Privacy Policy (anonymized analytics and legally-required retention).

You represent and warrant that you have all rights necessary to grant this license and that Your Content does not violate any law or third-party right.

7. Our Intellectual Property

The Service — including the platform, software, design, brand, logos, and all content we provide — is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. We reserve all rights not expressly granted.

8. AI-Generated Content and Accuracy

The Service relies on large language models from third-party providers (currently OpenAI and Google) to parse resumes, generate Bot replies, redact personal information, and produce insights. You acknowledge and agree that:

  • AI-generated output can be inaccurate, incomplete, or inconsistent with the underlying resume, and may produce statements you did not make.
  • Bot responses are AI-generated and should not be treated as your personal statements, sworn representations, or as legal, professional, medical, or financial advice.
  • You are responsible for reviewing your Bot settings, starter prompts, restricted topics, and the resume content you publish, and for any consequences of recruiter conversations conducted via the Service.
  • We make no warranty that AI output will be free of errors, bias, or undesirable content.

9. Plans, Billing, and No-Refund Policy

The Service offers a Free plan (limited to a fixed number of conversations) and paid plans (currently Lite, Basic, and Pro). Paid plans, plan limits, and prices are described on our pricing page and may change over time. Prices are displayed in US Dollars (USD). Payments are processed by Razorpay; we do not store your card details.

Paid plans are one-time purchases of conversation capacity, not subscriptions. There is no recurring charge and no auto-renewal. Purchased conversations do not expire, and buying a further plan adds to your existing balance rather than replacing it.

No refunds. All fees are non-refundable. Conversations, credits, and plan capacity, once purchased or consumed, are non-refundable and non-transferable, except where refunds are mandated by applicable consumer-protection law that cannot be waived by contract. Our Cancellation and Refunds policy sets out how to raise a billing dispute and the timelines we work to.

Taxes are your responsibility unless we are required by law to collect them. Failed payments may result in suspension of paid features until the balance is resolved.

10. Cancellation and Account Deletion

Because paid plans are one-time purchases, there is no recurring charge to cancel and you will never be billed automatically. You can delete your account in full at any time from your account settings, which permanently removes your direct personal data and unpublishes your Bot. Anonymized analytics and records we are legally required to retain (for example, payment records) are handled as described in our Privacy Policy.

11. Third-Party Services

The Service uses third-party processors (including Supabase, Vercel, OpenAI, Google AI, Razorpay, Resend, Cloudflare, and Upstash) to operate. Your use of the Service is also subject to the terms and policies of those providers where they apply to you. We are not responsible for the acts or omissions of third parties.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT AI OUTPUT WILL BE ACCURATE OR SUITABLE FOR ANY PURPOSE.

Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the exclusions above apply to the maximum extent permitted by law.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL MYINTERACTIVECV, ITS AFFILIATES, OR ITS SUPPLIERS BE LIABLE FOR (A) ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR (B) ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR JOB OPPORTUNITIES, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (II) USD 50.

14. Indemnification

You agree to defend, indemnify, and hold harmless MyInteractiveCV, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Service, (b) Your Content, (c) your violation of these Terms, or (d) your violation of any law or third-party right.

15. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law, if continued provision of the Service poses a security or legal risk, or if we discontinue the Service. You may stop using the Service at any time. Sections that by their nature should survive termination (including those on intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of India, without regard to its conflict-of-laws principles. You and we submit to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India for any dispute arising out of or relating to these Terms or the Service, subject to any mandatory consumer-protection rights you have under local law.

17. Changes to the Terms

We may update these Terms from time to time. The “Effective” date at the top reflects the most recent revision. For material changes, we will notify you by email or in-product notice. Continued use of the Service after the change takes effect constitutes your acceptance of the updated Terms.

18. Miscellaneous

Severability

If any provision of these Terms is found unenforceable, that provision will be modified to the minimum extent necessary to be enforceable, and the remaining provisions will continue in full force.

No Waiver

Our failure to enforce any provision is not a waiver of that provision.

Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.

Entire Agreement

These Terms, together with the Privacy Policy and any additional terms we present for specific features, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
